Eight states sue OpenAI over alleged risks to children using ChatGPT
Eight states filed separate lawsuits accusing OpenAI of misleading users about ChatGPT’s safety and failing to protect children.
Eight states announced lawsuits against OpenAI on October 14 over allegations that ChatGPT endangers children and that the company misrepresented its safety. The cases were filed separately in state courts by Iowa, Kansas, Nebraska, West Virginia, Arkansas, Arizona, Idaho and Montana.
The states allege that the chatbot has encouraged harmful behavior, including self-harm and violence, while presenting itself as supportive. Iowa Attorney General Brenna Bird said her case seeks to enforce the state’s consumer fraud law. These claims are allegations, rather than court findings.
OpenAI spokesperson Drew Pusateri said the company already provides protections tailored to users’ ages and intends to strengthen its safeguards. He pointed to parental controls and reminders to take breaks, and said OpenAI wants to work with states on policies covering the wider AI industry.
The lawsuits follow OpenAI’s introduction of a dedicated ChatGPT experience for teenagers. The company says users identified as minors receive additional protections, while linked parental accounts can manage selected settings and receive certain safety alerts.
The attorneys general are seeking changes to safety practices and the return of money allegedly earned while minors were harmed. They did not announce a specific damages amount, and officials said additional states could bring cases.
