Judge rejects administration bid to dismiss NAACP pollution lawsuit against xAI
A federal judge allowed government intervention but rejected its effort to end an NAACP lawsuit over turbines powering xAI infrastructure.
A federal judge has rejected the Trump administration's effort to dismiss an NAACP environmental lawsuit against Elon Musk's xAI. Judge Debra Brown allowed government intervention but rejected its claimed authority to end the case unilaterally.
The lawsuit challenges gas turbines operated by xAI and subsidiary MZX Tech in Southaven, Mississippi. The NAACP and its Mississippi affiliate allege that the companies failed to obtain required environmental permits. Those allegations remain unresolved.
The Justice Department sought intervention and dismissal in June, arguing that the facility supports economically important AI development and national security. It also said Mississippi authorities had determined that the disputed equipment did not require a permit.
The dispute also concerns the government's power over environmental lawsuits brought by private plaintiffs. The ruling leaves the underlying case pending and does not establish that xAI broke the law.
